Clearly Unconstitutional Law of the Month: South Carolina bill will make it illegal for any person on the sex offender registry to be awarded custody. (See, Stanley v. Illinois (US 1972) "Procedure by presumption is always cheaper and easier than individualized determinations, but when, as here, it needlessly risks running roughshod over the important interests of both parent and child, it...can not stand.")
